1. Acceptance of Terms

By accessing and using the services of Tech by EMC (“we,” “us,” or “our”), you agree to be bound by these Terms & Conditions. These terms govern your use of our website and services, including web development, SEO, social media management, and paid advertising.

2. Services and Deliverables

We agree to provide the digital marketing services as outlined in your specific project proposal or agreement. The scope of work, deliverables, and timelines will be defined in that document. Any requests for work outside of this agreed-upon scope will be considered a new project and may incur additional charges.


3. Client Responsibilities

For the success of any project, you agree to:

  • Provide all necessary information, content, and access to third-party accounts (e.g., website hosting, social media profiles, ad accounts) in a timely manner.

  • Ensure all content and materials you provide for use on your website or in campaigns do not violate any copyright or intellectual property laws.

  • Provide timely feedback and approvals as requested to avoid project delays.


4. Payments and Fees

All service fees are specified in your project proposal. We may require an upfront deposit before work begins, with the remaining balance due upon project completion or at agreed-upon milestones. Payments must be made on time. Failure to do so may result in the suspension of services or project delays. All fees are non-refundable unless specified in our separate Refund Policy.


5. Intellectual Property

  • Client-Owned Property: All materials you provide to us remain your intellectual property.

  • Tech by EMC-Owned Property: All strategies, methodologies, and internal tools we use to provide the services remain our intellectual property.

  • New Content: Any content (e.g., website design, social media posts, ad copy) created by us for your project will become your intellectual property upon final payment for that specific service.


6. Confidentiality

Both parties agree to keep all non-public information confidential, including business strategies, financial data, and project details. This obligation remains in effect even after the termination of our agreement.


7. Limitation of Liability

Our services are provided “as is.” We are not liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities, that may arise from the use of our services. Our total liability to you for any claim shall not exceed the amount you paid for the specific service in question.


8. Termination of Service

Either party may terminate the service agreement with written notice if the other party breaches these Terms & Conditions. Upon termination, you will be responsible for any outstanding fees for work completed up to the date of termination.


9. Governing Law

These Terms & Conditions are governed by the laws of the jurisdiction where Tech by EMC is registered. Any legal disputes will be resolved in the courts of that jurisdiction.

10. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. We will post any changes on this page, and your continued use of our services constitutes your acceptance of the new terms.
